Privacy policy

Acreditar respects the privacy of all individuals with whom it interacts in the pursuit and support of its work assisting children and young people with cancer and their families. This Privacy Policy describes who we are, for what purposes we may use your data, how we process it, with whom we share it, how long we retain it, as well as how to contact us and exercise your rights.

Who we are?

Your data will be processed by Acreditar – Associação de Pais e Amigos de Crianças com Cancro, legal entity number 503571920, with registered office at Rua Professor Lima Basto, nº 73, 1070-210 Lisbon, hereinafter “Acreditar” or “we”. This association is the Personal Data Controller within the meaning of the General Data Protection Regulation.

For questions related to the processing of your data, you should contact Acreditar.

Why do we need your information?

Acreditar will process your personal data for the following purposes:

  • Fundraising
  • Event organization
  • Management of foster homes
  • Volunteer management
  • Support logistical, legal, emotional, psychological, school and/ or social, organization of trips, meetings and holiday of camps


The processing of your data is necessary for the proper management of the relationship between the parties, the issuance of receipts, and all actions related
with actual or potential donations, the proper management of volunteer work, services provided to families as well as to children and patients, and activities under the responsibility of Acreditar or third parties on behalf of Acreditar. If you do not provide your data, we will not be able to provide you with the requested or contracted services. Your personal data will be kept for as long as the relationship that led to its collection lasts, for up to 10 years after its termination whenever there are tax obligations, or 5 years if there are none. In the case of personal data of families of children/adolescents/young adults with cancer, the data will be kept indefinitely given the possibility of a relapse at any time.

Marketing

Acreditar may process your data to send you information about its services and activities in general so that you are aware of how the association’s resources are spent. You may object to this data processing at any time. Your data will be kept for this purpose for up to 5 years after your last donation or action in favor of Acreditar, except in cases where the Portuguese Tax Authority establishes a period of 10 years, in which case that period will apply.

Definition of profiles

Acreditar may process your personal data to assess your potential interest in collaborating with the association, whether through volunteering, donations, or partnerships for cooperation or organizing events in favor of the association, as well as to define services to be provided. Acreditar will not make any decisions based on your profile that produce legal effects on you. You may object to this data processing at any time. Your data will be kept for this purpose for 5 years from your last interaction with Acreditar, or 10 years in cases where there is a tax obligation.

Management of complaints and contacts received by the Association

You can send us suggestions or complaints regarding the services provided by Acreditar via the email address RGPD@acreditar.pt or the telephone number 217221150. Your personal data will be processed based on Acreditar’s legitimate interest and your consent. Acreditar collects your data to analyze and resolve the situation underlying your suggestion or complaint. Your data will be kept for this purpose for the time necessary to resolve your issue, and will be destroyed one year after the complaint is resolved.

Supplier/Subcontractor Management

The processing of your data is necessary for the execution of the contract to be entered into between you and Acreditar, or for carrying out pre-contractual due diligence at your request. If you do not provide your data, we will not be able to fulfill the contractual obligations assumed.
Your data will be kept for this purpose for 10 years.
The personal data of suppliers may be processed by Acreditar for the purpose of dispute management. The legal basis is the existence of a legitimate interest on the part of the association, and the data will be kept for the period necessary for the exercise of the respective rights.
The data of the association’s suppliers, especially employees, may be communicated to other persons or entities with which the association is related, for the fulfillment of legal or contractual obligations.

Will my information be shared with others?

Your personal information may be disclosed: if you are our donor, member, patron, volunteer, Barnabé, caregiver or family member of a sick child or young person, supplier or partner, your personal data may be processed by companies subcontracted by the association, namely for website hosting, email, accounting, database management and other subcontracted services. These companies are only provided with the personal data necessary for the provision of the service in question. Personal data may also be accessed by Acreditar’s internal and external auditors, with the guarantee that it will be kept confidential and will not be used for purposes unrelated to the audits. Your data will be processed within the European Union.

What are my rights?

You can contact us at any time:

  • Access to the information we hold about you;
  • Correcting the information if it is inaccurate or incomplete;
  • The erasure or restriction of the processing of your personal data;
  • If the processing depends on your consent or the conclusion of a contract and this processing is carried out by automated means, you have the right to receive the personal data you previously provided, in a structured, commonly used and machine-readable format.

Your requests will be handled with special care so that we can ensure the effectiveness of your rights. You may be asked to prove your identity to ensure that personal data is only shared with its owner. You should bear in mind that in certain cases (for example, due to legal requirements) your request may not be fulfilled immediately. In any case, you will be informed of the measures taken in this regard within one month of the request being made. You also have the right to lodge a complaint with the National Data Protection Commission https://www.cnpd.pt/.

The holder of personal data has the right to obtain from Acreditar confirmation as to whether or not data concerning him or her are being processed and, if so, to access his or her personal data and the information provided for by law.

The holder of personal data has the right to obtain from Acreditar, without undue delay, the rectification of inaccurate or incomplete personal data concerning him or her.

The data subject has the right to obtain from Acreditar the erasure of their data without undue delay, and Acreditar has the obligation to erase personal data without undue delay when, in particular, one of the following grounds applies:

  1. The personal data is no longer necessary for the purpose that motivated its collection or processing;
  2. The data subject has withdrawn their consent to the processing of their data (in cases where the processing is based on consent) and there is no other legal basis for said processing;
  3. The data subject objects to the processing and there are no overriding legitimate interests that justify the processing.

The data subject has the right to obtain from Acreditar the restriction of processing, if one of the following options applies:

  1. To contest the accuracy of personal data for a period that allows Acreditar to verify its accuracy;
  2. The processing of data is unlawful and the data subject objects to the erasure of personal data and requests, instead, the restriction of its use;
  3. Acreditar no longer needs personal data for processing purposes, but this data is required by the data subject for the establishment, exercise or defense of a legal claim.
  4. If you have objected to the processing, it will remain pending until it is verified that the legitimate grounds of the controller override those of the data subject.

If the processing depends on the data subject’s consent and that consent has been given by automated means, the data subject has the right to receive the personal data concerning him or her, which he or she has provided to Acreditar, in a structured, commonly used and machine-readable format.

In cases where data processing is carried out for the purposes of the legitimate interests pursued by Acreditar, or 2) data processing is carried out for direct marketing purposes or 3) profiling, you may also object to the processing of your personal data at any time.

If consent is legally required for the processing of personal data, the data subject has the right to withdraw consent at any time, although this right does not compromise the lawfulness of the processing carried out based on the consent previously given, nor the subsequent processing of the same data based on another legal basis, such as compliance with the contract or the legal obligation to which Acreditar is subject.
